Charges detailed against former Coach Barnard in district court

Former Marshall County Football Coach Ron Barnard was arraigned in Marshall District Court on Monday morning. Barnard was arrested on June 4, 2014 and charged with one count of Unlawful use of electronic means originating or received within the Commonwealth to induce a minor to engage in sexual or other prohibited activities – Class D Felony, 2 counts of Distribution of obscene matter to minors – Class A Misdemeanor and one count of Solicitation of Promoting a sexual performance by a minor – Class C Felony.
McCracken County Public Defender stood in for Barnard’s attorney and asked that Barnard’s $10,000 cash bond be converted to a property bond. After the prosecution opposed that request a bond hearing is set for today, Wednesday, June 11, 2014 at 1 p.m. A tentative date for a preliminary hearing was discussed and June 18, 2014 is the date set as a tentative scheduled time.
The charges against Barnard resulted from information gleaned from two different fake Twitter accounts and audio and video recordings that were secretly made of conversations made between Barnard and the 15-year-old girl at the high school.
The charges against Barnard were filed after a lengthy investigation by Marshall County Sheriff’s Detective Lt. Matt Hilbrecht. According to documents filed along with the charges against Barnard Lt. Hilbrecht sought and got access to two different fictitious Twitter accounts that Barnard is alleged to have arranged with a 15-year-old freshman girl at Marshall County High School.
According to these same documents filed by Lt. Hilbrecht it was stated that on or about May 30, 2014 he received information that alleged that Barnard was possibly having improper contact with a 15-year-old freshman girl at Marshall County High School. In Lt. Hilbrecht description of his interview with the girl it states “she stated that Barnard had on one occasion attempted to put his hand down her pants at school, and further stated that Barnard suggested that they both create fake Twitter accounts to communicate with one another.”
Lt. Hilbrecht’s filing against Barnard also contained the following allegations, “On June 2, 2014, Barnard and (name redacted) had a conversation using the fake accounts. On June 3, 2014 (name redacted) was equipped with a video/audio recording device and went to the high school where she encountered Barnard in the hall. During conversation, Barnard is heard specifically telling (name redacted) to use their “second” accounts and for her not to follow him on his real account. Barnard is also heard telling (name redacted "to send him something ‘beautiful’.”
The filing against Barnard also alleges that, “Later that evening and into the morning hours of June 4, 2014 using the prearranged fake account Barnard engaged in a sexually charged with (name redacted) where he repeatedly told her she was ‘explicative deleted-Hot’ and asked for pictures, Specifically, Barnard at one point asked (name redacted) to send him a nude picture of her without panties on showing him the front and back. Barnard also asked her to send pictures of (name redacted) bending over and dancing in a provocative manner. Barnard also sent 3 (three) pictures, one of which showing an unidentified nude male holding the male’s erect penis, a second picture purporting to be Barnard’s penis, and a third picture purporting to be Barnard’s nude buttocks. On the picture showing the buttocks, the man in the picture has a similar body style of Barnard and also appears to be wearing the same shirt that Barnard is seen on the earlier recorded video wearing at school. Also during the conversation, Barnard and (name redacted) talk about Barnard bringing alcohol to (name redacted) house when her parents are not at home.”
